- Acceptance of Terms
By engaging Excavation Point LLC for excavation, drainage, grading, or any other services, you agree to these Terms of Service. If you disagree with any part of these terms, please contact us before proceeding with our services.
- Description of Services
Excavation Point LLC provides excavation, drainage solutions, grading, concrete preparation, stormwater management, gravel surface installation, and custom builder services throughout Central Ohio. The specific services to be provided will be outlined in a written estimate or contract.
- Estimates and Pricing
- All estimates are valid for 30 days from the date issued.
- Estimates are based on visible conditions and information provided at the time of assessment.
- Unforeseen conditions discovered during work may require additional services at additional cost.
- A signed estimate or contract and deposit (if required) must be received before work will commence.
- Payment Terms
- Payment schedules will be outlined in your estimate or contract.
- For residential projects under $5,000, full payment is due upon completion.
- For larger projects, payment schedules typically include a deposit, progress payments, and final payment.
- Payments not received within 30 days of invoice date are subject to a 1.5% monthly late fee.
- Excavation Point LLC reserves the right to place a mechanic’s lien on properties where payment remains outstanding.
- Cancellation Policy
- Cancellations made more than 48 hours before scheduled work incur no penalty.
- Cancellations within 48 hours of scheduled work may incur a fee to cover scheduling and preparation costs.
- For ongoing projects, early termination fees may apply as specified in your contract.
- Project Timeline
- Project timelines provided are estimates and may be affected by weather, unforeseen site conditions, or other factors outside our control.
- Excavation Point LLC will communicate any anticipated delays promptly.
- Permits and Regulations
- Clients are responsible for obtaining necessary permits unless otherwise specified in writing.
- Excavation Point LLC will perform work in compliance with applicable local regulations.
- When work requires inspection, scheduling inspections is typically the client’s responsibility unless otherwise agreed.
- Property Access and Site Conditions
- Clients must provide reasonable access to the work site.
- Client is responsible for marking or disclosing known underground utilities or structures.
- Excavation Point LLC will contact Ohio Utilities Protection Service (OUPS) for public utility marking but cannot be responsible for private, unmarked utilities.
- Client acknowledges that excavation and drainage work may impact landscaping and surrounding areas.
- Warranty
- Excavation Point LLC provides a 1-year warranty on workmanship for completed projects.
- Material warranties are limited to those provided by manufacturers.
- Warranty does not cover damage caused by Acts of God, improper maintenance, or modifications by others.
- Warranty claims must be submitted in writing.
- Limitation of Liability
Excavation Point LLC’s liability is limited to the contract amount for the specific project. We are not liable for indirect, incidental, or consequential damages.
- Insurance
Excavation Point LLC maintains appropriate business insurance. Proof of insurance is available upon request.
- Dispute Resolution
Any disputes shall first be addressed through good-faith negotiation. If resolution cannot be reached, disputes will be resolved through binding arbitration in Ohio.
- Changes to Terms
Excavation Point LLC reserves the right to modify these terms. Current terms will always be available on our website.
